Appeals and Review

If an applicant’s visa, nomination, or sponsorship application has been refused or cancelled by the Department of Home Affairs, they may be eligible to request a review of the decision through the Administrative Appeals Tribunal. The AAT undertakes a merits review, which means it revisits the facts, legislation, and policy that are important to the judgment. During the review process, the AAT has the right to confirm, modify, reverse, or return the decision for further consideration.

It is critical to understand that there are severe legislative time constraints in force. Failure to submit the review application within the required time limit may result in the loss of the option to have the decision reviewed. Consequently, applicants must move quickly to ensure that their review application is submitted by the deadline.
