General information about skilled and complex migration in Australia. Your circumstances may change the answer.
Subclass 189 is an independent skilled visa that does not require employer sponsorship or state nomination. You must receive an invitation and satisfy the applicable occupation, skills assessment, age, English, points and other visa requirements. Subclass 190 is a permanent state-nominated visa with 5 nomination points, subject to visa and nomination requirements. Subclass 491 is a regional provisional visa with 15 points for qualifying nomination or family sponsorship. Eligible 491 and 494 holders may later apply separately for subclass 191 after meeting the visa-holding, compliance, tax-evidence and other requirements. Three years passing does not automatically grant permanent residence.
The points test awards points for factors such as age, English proficiency, eligible skilled employment, qualifications, partner circumstances and qualifying nomination or sponsorship. For points-tested skilled visas, you need to meet or exceed the minimum threshold of 65 points to be invited to apply. Meeting that threshold does not guarantee an invitation, and the points you claim must be accurate and supported. Invitation scores vary by occupation, subclass and round and can exceed the minimum. Published past results provide context, not a prediction of your next invitation.
A visa refusal is not necessarily the end. Depending on your circumstances and the decision, review or other options may be available. We have experience representing clients at the Administrative Review Tribunal (ART). Strict time limits apply and vary by decision. Check your decision notice and seek advice promptly; booking a consultation does not extend a deadline.
Employer-sponsored pathways include the Skills in Demand visa (subclass 482), Employer Nomination Scheme (subclass 186), and Skilled Employer Sponsored Regional (Provisional) visa (subclass 494). The appropriate pathway depends on the role, employer, applicant and applicable requirements. We advise employers and applicants on sponsorship, nomination and visa applications.
The Administrative Review Tribunal (ART) conducts merits review of certain migration decisions where review rights exist. A review may involve written material and, where applicable, a hearing. Most affected student-refusal reviews are decided without an oral hearing under the current rules. Review rights, deadlines and visa status need an individual assessment. We can assist with eligible review applications, evidence and submissions within the agreed scope. No outcome is guaranteed.
