Strict deadlines apply. Do not wait.

Have the decision, notification details and exact review deadline assessed promptly. Do not assume you have 28 days or wait for the next available appointment.

  • Eligibility. Not every decision can be reviewed. The decision type, decision-maker, applicable law and person entitled to apply must be checked. In some matters the eligible applicant is the sponsor, not the visa applicant.
  • Status. An ART application does not automatically give you lawful status, a bridging visa, work rights, travel permission or permission to return to Australia. Assess these separately.
  • Booking. Booking a consultation, contacting iExcel or completing visitor registration does not lodge an ART application or stop a deadline. Do not rely on a booking confirmation to protect review rights or visa status.
  • Documents. If available, the decision letter, decision record and details of when and how you received them help identify review rights and deadlines. Do not delay initial contact while collecting a complete file.
Examples of how review time limits can differ

Illustrations only, not a calculator. Your exact deadline depends on your decision notice and how it was given to you.

Migration and protection reviews
A 28-day application period applies to many reviewable migration and protection decisions. Other categories have different rules. This is not a deadline for your particular decision.
Immigration detention
A 14-day period can apply to migration or protection reviews where the applicant is in immigration detention. The applicable circumstances and notification rules must be checked.
Expedited character reviews
Certain eligible character reviews are subject to a nine-day statutory application period under Migration Act s 500(6B), calculated from notification under s 501G(1). Reviewability, the notification event and the exact deadline must be checked urgently for the particular decision. Do not use this page to calculate your deadline.
No general extension
The ART cannot extend the statutory application periods for the migration/protection and expedited character reviews described here. Verify the decision notice and applicable law immediately; do not use these examples to calculate your deadline.

Important cautions

  • Not every cancellation is reviewable by the ART. The cancellation power and whether the decision was made by a delegate or personally by the Minister can change the available process.
  • Certain expedited character reviews have a nine-day application limit; do not assume every cancellation has that period or a longer general deadline.
  • Do not depart Australia assuming that a pending review protects your ability to return. Travel can affect visa status, rights and the applicable process.
  • ART merits review is not court judicial review. Court proceedings concern legal error and have separate eligibility and deadlines. Obtain advice from an appropriately qualified Australian legal practitioner for court or other matters beyond these migration services.
  • A review is not guaranteed to succeed. New evidence does not automatically cure a refusal or cancellation ground, and a favourable review does not necessarily result in an immediate visa grant.

What this page covers

Cancellation grounds · lawful status · urgent review assessment

How the process works

  1. Identify the cancellation decision, relevant legislative power, decision-maker and notification details.
  2. Check whether ART review is available, the eligible applicant and applicable application and procedural deadlines.
  3. Assess visa status, detention or removal concerns and any bridging visa possibilities separately.
  4. If eligible, lodge a valid review application within time and prepare relevant evidence and submissions.
  5. Follow the correct review procedure. Character matters can have distinct rules and may need specialist legal assistance.

Documents that may help (optional at first contact)

  • Decision letter and reasons, if available, together with when and how the notification was received.
  • Current and previous visa information and relevant immigration history.
  • The original application, Department correspondence and supporting material, if available.
  • Any existing ART application, acknowledgement, directions or scheduled events.
  • Relevant compliance, correction, relationship, character or other evidence specific to the cancellation ground. Do not assume all categories permit the same evidence or procedure.

How we help

  • Assess eligible cancellation decisions, review rights and current migration status.
  • Review the cancellation grounds and the relevant supporting material, including Department requests and responses.
  • Assist with eligible ART applications and case preparation within migration services. Specialist legal advice may be needed for character, detention, removal or court issues.
