Proposed Cancellation — NOICC

A Notice of Intention to Consider Cancellation is not itself a final cancellation decision. Understand the grounds, response opportunity and current visa position before deciding how to respond.

Office hours Monday–Friday, 9 am–5 pm. Not a 24/7 service. To book, choose a time first, then complete the visitor registration form.

Check the notice and response deadline first.

A Department concern is not necessarily a final refusal or cancellation. Identify the exact notice, legal basis and required response before acting.

  • Deadlines. Response periods depend on the notice, notification rules and applicable law. Verify the deadline and submission method promptly. Any extension must be available under the process and confirmed; do not assume that requesting one pauses the deadline.
  • Status. A Department notice, a response or a waiver request does not itself extend a visa, grant a bridging visa or create work or travel rights. Check the visa actually in effect and its conditions separately.
  • Booking. Booking, contacting iExcel or completing visitor registration does not submit a response to the Department, pause a response deadline or extend your visa.
  • Documents. If available, the notice and decision-related correspondence, the response deadline, visa details and relevant application records can help. Do not delay first contact while collecting a complete file; documents are not a prerequisite for booking.

Important cautions

  • Do not mistake a NOICC for a final decision or assume a response will prevent cancellation.
  • Do not assume every cancellation requires an advance NOICC or shares one response period.
  • Continuing work or travel depends on the visa actually in effect, its conditions and any later decision—not the existence of a response process.
  • An explanation, correction or supporting submission does not guarantee that a concern will be resolved, a waiver exercised or a visa granted. Outcomes depend on the facts and applicable law.

What this page covers

Identify the cancellation power and what the notice actually invites you to address. Different powers and circumstances can involve different procedures.

Important distinctions

Proposed is not final
A NOICC says cancellation is being considered under the relevant process. It does not itself establish that the visa has already been cancelled.
No single notice procedure
Do not assume every cancellation is preceded by the same notice or permits the same response period. Character, mandatory-cancellation and other powers must be assessed under their own rules.
Visa status remains a separate check
If a visa remains in effect, its actual conditions continue to govern work, study and travel. The notice does not extend its expiry or create extra permission; verify current status and any subsequent decision.

How the process works

  1. Read the grounds, alleged facts and statutory power in the notice.
  2. Verify the response deadline, notification circumstances and permitted submission method.
  3. Review the relevant application history, conditions and evidence addressing the allegations.
  4. Prepare an accurate response addressing the statutory issues and any relevant discretion.
  5. Follow the matter to the decision and assess any review rights and status consequences separately.

Documents that may help (optional at first contact)

  • The notice, supporting allegations and relevant correspondence, if available.
  • Visa grant, conditions and application records relevant to the concern.
  • Records explaining compliance, changed circumstances or disputed information.
  • Documents responsive to the particular cancellation grounds, rather than a generic bundle.

How we help

  • Review the notice and identify the legal and factual issues.
  • Assess relevant evidence and prepare a structured response within the permitted migration service scope.
  • Explain potential status consequences and next steps without assuming cancellation or review eligibility.
